Preliminary considerations
Cookies are small text strings that sites visited by users send to their terminals (usually browsers), where they are stored to be later retransmitted to the same sites during subsequent visits by the same users. However, the legislator has moved in this direction and, on implementing the provisions of Directive 2009/136/EC, has included the obligation to acquire the prior and informed consent of users to the installation of cookies used for purposes other than merely technical ones (see Article 1(5)(a) of Italian Legislative Decree 28 May 2012, no. 69, which amended Article 122 of the Code).

 

In this regard, and for the purposes of this measure, two macro-categories are therefore identified: “technical” cookies and “profiling” cookies.

  1. Technical Cookies

 

Technical cookies are those used for the sole purpose of “carrying out the transmission of a communication over an electronic communications network, or as strictly necessary to the provider of an information society service explicitly required by the subscriber or user to provide that service” (see Article 122(1) of the Code).

 

They are not used for any further purpose and are normally installed directly by the website owner or operator. They can be divided into navigation or session cookies, which ensure normal navigation and use of the website (making it possible, for example, to make a purchase or authenticate oneself to access restricted areas); analytics cookies, similar to technical cookies when used directly by the site operator to collect information, in aggregate form, on the number of users and how they visit the site; functionality cookies, which allow the user to browse based on a number of selected criteria (for example, language, products selected for purchase) in order to improve the service rendered to the user.
